Service descriptions, scope, and pricing are provided on our website or agreed upon prior to the commencement of work. All services are delivered according to the agreed plan, scope, or package.


2. Service Delivery & Access

To deliver our services, you may be required to provide:

  • WordPress admin access
  • Hosting or server credentials
  • FTP/SFTP or database access

You confirm that you have the legal right to grant us such access. Access will be used solely for service delivery. Clients are responsible for maintaining backups, unless otherwise agreed.


3. Payments & Pricing

  • All prices are listed in the applicable currency and are payable in advance, unless otherwise stated.
  • Deposits for custom development projects are applied toward the total quoted cost.
  • Monthly subscriptions (Starter, Business, Agency plans) renew automatically unless cancelled before the next billing date.
  • Failure to make payment may result in delayed or suspended services.
  • Prices may change without prior notice for future purchases.

4. Refunds & Service Credits

Refunds are governed by our Refund & Service Policy, which forms part of these Terms. By purchasing any service, you acknowledge that you have reviewed and agreed to the Refund Policy.

  • One-time services, deposits, and subscription charges are subject to the terms outlined in that policy.
  • Refunds or service credits may be issued only as specified for certain service types (e.g., Speed Optimisation partial refund criteria).

5. Client Responsibilities

You agree to:

  • Provide accurate and complete information
  • Respond promptly to requests for access, clarification, or approval
  • Ensure your website complies with applicable laws and regulations

Delays caused by missing information or unresponsiveness may impact delivery timelines.


6. No Guarantees

While we strive to deliver high-quality results, you acknowledge that:

  • Website performance depends on hosting, third-party plugins, themes, and infrastructure
  • We cannot guarantee specific rankings, traffic, or absolute performance scores
  • Security services reduce risk but cannot guarantee immunity from future attacks

7. Limitation of Liability

To the maximum extent permitted by law, A Digital Star shall not be liable for:

  • Loss of revenue, profits, or business opportunities
  • Data loss where backups were not provided or maintained by the client
  • Issues caused by third-party software, hosting providers, or external services

Our total liability shall not exceed the amount paid for the specific service giving rise to the claim.


8. Intellectual Property

Unless otherwise agreed:

  • Custom code developed remains the property of the client upon full payment
  • A Digital Star retains the right to reuse general knowledge, techniques, and non-proprietary components
  • You grant us permission to display completed work in our portfolio unless explicitly requested otherwise in writing

9. Termination

We reserve the right to refuse or terminate service if:

  • Abusive, unlawful, or fraudulent behavior is identified
  • The service request violates applicable laws or hosting policies
  • Continued work poses security, ethical, or compliance risks

No refunds will be issued for terminated services where work has already commenced.


10. Third-Party Services

Our services may rely on third-party tools, plugins, themes, or hosting providers. We are not responsible for changes, failures, or outages caused by these third parties.


11. Subscription & Recurring Services

  • Monthly subscriptions for Support Plans are billed in advance and renew automatically unless cancelled.
  • Refunds for subscriptions are limited to the current billing period if we fail to deliver services as outlined.
  • Cancellation requests must be submitted before the next billing cycle to prevent automatic charges.

12. Changes to These Terms

We may update these Terms from time to time. Continued use of our website or services after changes constitutes acceptance of the updated Terms.


13. Governing Law
